Most people know that driving under the influence of alcohol or drugs is reckless, dangerous, and illegal in all 50 states. What you may not know is that driving while tired is also a type of impaired driving can be just as risky as driving impaired under the influence of drugs or alcohol.

Commercial truck drivers can cause particularly catastrophic crashes when they drive drowsy, which is why they are subject to unique driving time restrictions that aim to ensure they do not drive while tired. If you believe you are one of the many people who have been harmed by a fatigued truck driver driving on Casper roads, our team of tenacious and compassionate Wyoming personal injury attorneys at the Law Firm for Truck Safety can help you build a path to justice and civil recovery.

When Is a Truck Driver Considered Dangerously Fatigued?

Unlike alcohol intoxication, there is no objective way to measure how tired you are or how much sleep you got the night before. However, it is possible to objectively determine whether a truck driver complied with the driving time limits set by the Federal Motor Carrier Safety Administration (FMCSA) in 49 C.F.R Section 395, which are:

  • No more than 11 total hours of driving in one working day, after an off-duty period of at least 10 consecutive hours
  • No more than 14 total hours on duty in one working day, after an off-duty period of at least 10 consecutive hours
  • No more than eight total hours of driving without at least one break of at least 30 minutes
  • No more than 60 total hours spent on duty within a seven-day period or 70 total hours on duty within an eight-day period, both reset by an off-duty period of at least 34 consecutive hours

In Casper, any driver whose driving logs indicate a violation of these rules—or who knowingly alters or provides false information in such logs—may be legally at fault for any truck crash they cause due to exhaustion. Because driving logs can sometimes be falsified or manipulated to hide hours-of-service violations, an experienced attorney can investigate records, uncover inconsistencies, and work to prove when driver fatigue contributed to a collision.

Holding Trucking Companies Liable for Overly Fatigued Drivers

While truck drivers may independently choose to drive drowsy to pad their paychecks, trucking companies may still be directly liable for having a policy that doesn’t safeguard against their drivers making unsafe decisions. Even still, the reality may be more complex, as there may be pressure – spoken or unspoken – put on employees to violate federal driving time regulations in order to save time and money on delivery routes. At The Law Firm for Truck Safety, our attorneys will take a deep dive into driver logs and company policies to determine if the working environment was a major contributing factor into creating or enabling the fatigued driver that caused your accident.
