Understanding Traumatic Brain Injuries Caused by Catastrophic Truck Accidents
Tractor-trailers, big rigs, 18-wheelers – commercial trucks go by many different names, but what they all have in common is their immense size: roughly 80,000 pounds when fully loaded.
When a semi strikes your car, the intense impact can cause your head to violently move back and forth, striking the inside of your vehicle. This motion and blunt force trauma cause the brain to collide with the inside of your skull, which then causes swelling, bleeding, and bruising. But the deceleration forces in a crash with a large truck are not the only way a TBI can occur. In severe crashes, a piece of wreckage can pierce the skull causing what is known as a penetrative TBI.
Types of traumatic brain injuries (TBI) commonly seen in serious truck wrecks include:
- Penetrating Brain Injury: This occurs when an object penetrates the brain. In truck crashes, these objects can include vehicle debris, cargo, or the commercial motor vehicle itself.
- Skull fracture: This occurs when pieces of the shattered skull become embedded in the brain. Sometimes the skull is fractured from debris in the truck crash. Other times the skull becomes fractured when the head hits the vehicle itself.
- Secondary Brain Injury: Secondary brain injuries occur when the initial crash trauma causes physiological disruptions that affect the blood-brain barrier disrupting the delicate balance of the brain’s chemistry.
Some secondary brain injuries interfere with blood flow resulting in insufficient oxygen in the brain. Others can cause cerebral edema – swelling of the brain – and raise the intracranial pressure, which, when too high, can be fatal.
- Diffuse Axonal Injury (DAI): If a truck crash is forceful enough, it can tear the brain’s connecting fibers (axons) causing a diffuse axonal injury. When this happens, the resulting DAI can leave crash victims in a coma and/or severely impede their brain functions.
- Brain Hemorrhage: Bleeding in and around the brain is life-threatening. Brain hemorrhages are often labeled based on where the bleeding occurs (intracranial hemorrhage, intracerebral hemorrhage, etc.)
Regardless of the type of head injury sustained, every truck accident victim faces a long road of emotional and physical recovery. Rest assured, our experienced team of truck crash attorneys is here to lend our strength, support, and courage to your recovery while simultaneously fighting to recover the compensation you deserve in the courtroom.
The days following a truck crash are critical for the success of your brain injury lawsuit.
When you hire our personal injury lawyers to champion your story, we will immediately:
Preserve crash scene evidence
We immediately work to find and preserve evidence, locate law enforcement reports, video recordings, audio recordings, and interview witnesses.
Partner with experts
One of our greatest strengths as a firm is our ability to manage the many legal and medical ramifications of brain injuries caused by truck crashes. We carefully consult with the medical professionals who treat our clients. We do this because it is crucial to the success of your case that we understand the diagnosis and prognosis of your head injury and can convey this information to jurors who will need it to render a fair verdict.
Insist on the maximum compensation
Unlike other personal injury law firms, we prepare every case for the courtroom. Our goal is to help you receive maximum compensation for the emotional, financial, and psychological harm a truck driver’s negligence has caused you. If defense attorneys are unwilling to offer a fair settlement for your brain injury, our trucking attorneys will confidently and swiftly take your TBI case to trial.
A Different Type of Crash Needs a Different Type of Attorney
Prosecuting a semi-truck accident claim is more complex than other personal injury cases and requires a thorough investigation of Federal regulations, driver’s logs, vehicle maintenance records, and more.
Whether your truck crash occurred in Oklahoma City, Norman, Moore, Tulsa, Broken Arrow, McAlester, Edmond, Durant, Ardmore, Lawton, Enid, Ponca City, Muskogee, or elsewhere in Oklahoma, successfully pursuing an Oklahoma truck crash, requires experience, knowledge of Oklahoma personal injury law and trucking industry regulations, and the resources to take on the insurance companies, defense counsel, and the trucking industry.
Unfortunately, many truck crash victims find that when they partner with a general personal injury lawyer with a diverse caseload, their truck accident — their needs — are treated just like an everyday car crash. This decision leaves many truck crash victims with traumatic brain or head injuries, feeling unsupported, underrepresented, and potentially walking away from millions of dollars in compensation.
At The Law Firm for Truck Safety, we offer our clients the following:
- Prompt updates on the status of their case
- Qualified representation and our experience litigating complex matters
- Skilled negotiations in mediation
- Respect and empathy for your pain
- Tenacious advocacy of your legal interests

Crash. Not Accident.
The word “accident” is often used to describe devastating truck crashes. Many people in need of legal help will search for a “truck accident lawyer near me” or the “best truck accident attorney”. We even use "accident" in our site name.
However, most truck “accidents” are not accidents at all.
Truck crashes are often caused by distracted, fatigued, poorly trained, or downright dangerous truck drivers and/or the unsafe business practices of the trucking companies and brokers that hired them. Every semi-truck accident lawyer at The Law Firm for Truck Safety is committed to helping those who have been irreparably harmed in commercial vehicle crashes and providing education to the public that crashes are not accidents.
What Causes a Traumatic Brain Injury (TBI) in a Truck Accident?
There is no reason why truck crashes should be accepted as a normal part of Oklahoman life. We believe that all truck crashes on Oklahoma roads are avoidable when proper care, training, and safety measures are taken. Truck accidents should not occur on US roads and certainly not crashes resulting in traumatic brain injuries, serious head injuries, or death.
All truck crashes that leave victims with TBI or other types of serious head injuries are the result of some type of negligence. If a semi-truck driver’s negligence played a role in your traumatic brain injury case, it is likely one or more of the following was a factor:

Trucking is a 24/7 industry, but truck drivers cannot drive 24/7. In 2020, there were an estimated 633 deaths in the United States from fatigued-driving-related crashes. Falling asleep at the wheel is a major concern for multiple US agencies, including the Centers for Disease Control & Prevention (CDC), the Food & Drug Administration (FDA), the Federal Motor Carrier Safety Administration (FMCSA), and the National Transportation Safety Board (NTSB).

According to NHTSA, In 2020, an estimated 3,142 people died in motor vehicle crashes involving distracted drivers – and thousands more were injured. Any activity that takes your hands, mind, or eyes off of driving is a distraction. Cell phones are one of the most problematic distractions. Because heavy semi-trucks take longer to stop than passenger vehicles, truck drivers are even more at risk of accidents caused by distraction

Driving under the influence of alcohol or drugs is a leading cause of vehicle accidents. NHTSA saw a double-digit (14%) increase in the number of drunk/drugged driving deaths from 2019 to 2020.

Trucking companies must follow federal regulations for maintenance and inspections. Defects in tires, brakes, lights, and other components often cause or contribute to accidents.

Unsecure and imbalanced cargo loads make semi-trucks harder to stop and maneuver, putting those around the tractor-trailer in danger of being hit by debris or components of the commercial motor vehicle itself.
It’s not just tractor-trailers that can cause a traumatic brain injury in an Oklahoma truck wreck. Any type of large truck or commercial motor vehicle can cause a severe head or traumatic brain injury. Large vehicles are commonly found liable in TBI-related crashes including:
- Box Trucks
- Dump Trucks
- Flatbed Trailers
- Logging Trucks
- Tow Trucks
- Garbage Trucks
- Vehicles carrying Hazardous Materials
- Tanker Trucks
- Busses
- Government and municipal trucks
Traumatic Brain Injury Signs & Symptoms
Brain injuries from a truck wreck often result from physical trauma to the brain but may also result from hypoxia or lack of oxygen to the brain. You don’t have to hit your head very hard to experience a minor concussion or moderate TBI; even two slow-moving vehicles colliding can result in serious injury.
Common TBI symptoms include:
- Balance issues
- Dizziness
- Fatigue
- Headache
- Irritability
- Loss of consciousness
- Memory loss
- Nausea
- Sleep issues
- Trouble concentrating
- Difficulty regulating emotions
Note: The initial symptoms may later develop into long-term conditions like depression, anxiety, PTSD, personality changes, and other physical and psychological changes.
The care and medical treatment needed to effectively treat your brain injury can vary widely based on the severity of your TBI. Victims who stabilize in the hospital may be transferred to a nursing unit, rehabilitation center, or outpatient care. Truck crash victims with more serious head injuries –particularly those who are unable to function independently — will need to explore options that include supported living facilities.
Whatever path of care is necessary, finding the appropriate treatment facility is essential, as many facilities are ill-equipped to handle truck crash victims with a TBI. If you suspect any trauma to the brain, skull, or head following an accident, or see a change in the crash survivor, seek medical treatment immediately.
Filing a Claim after your Head Injury Accident.
If you or a loved one suffered a brain injury in an accident involving an 18-wheeler, big rig, or another commercial vehicle, The Law Firm for Truck Safety can help you recover the maximum, full, and fair compensation that you are entitled to.
Our legal team is ready to treat you with the care, knowledge, and compassion needed to help you through these challenges.
Taking a Brain Injury to Trial: Common Types of Compensation and Damages
The medical care and time away from work can make even “mild” brain injuries financially burdensome. When a truck driver or trucking company negligence is responsible for your brain injury, you may be entitled to compensation for the following:
- Medical expenses: On its own, the medical treatment for your brain injury can easily reach hundreds of thousands of dollars. Medical care expenses can include initial ambulance transport, hospitalization, surgery, and other life-saving medical procedures, physical therapy, rehabilitation, long-term TBI care, and more.
- Lost earnings: If you are unable to work for any amount of time following your accident or are unable to return to work in the same capacity, you may use your truck crash lawsuit to recover compensation for the loss of income you would have otherwise earned, had your truck crash never occurred.
- Pain and suffering: The cost of your brain injury exceeds far beyond the measurable damages of medical care and time away from work – and courts and insurance companies consistently recognize this. In most states, you may receive compensation for the emotional and psychological harm someone else’s negligence has caused you and your family.
- Loss of normal life/ loss of enjoyment of life: For most truck crash victims, life before and after your crash looks dramatically different. In most states, compensation can be awarded for the adverse and lasting impact that your truck crash injury will have on your overall quality of life.
I am a professional truck driver. When I was injured, [I was] immobilized by my injuries and the surgery that followed. Joe was so much more than I hoped, and the settlement I received was terrific. He is not just my lawyer, he is my friend.
Joe knows what he is doing, and he is determined. He takes care of the people he helps, and he doesn’t leave them until the work is done. Joe Ervin is...the only lawyer I would send my friends or family to see.
A pleasure to work with and the best at identifying coverage when others can’t!
My mother was killed and my son was badly injured in a head-on accident. Joe Ervin made sure that we knew what was happening at every stage of the process. [Joe] is a terrific lawyer and a good man. I would send my family or friends to him, no question.
Outstanding service and attention to detail. Would highly recommend them.
