US-35, Ross County, OH
Rear Underride Crash |Wrongful Death
While driving down U.S. 35, a dump truck carrying asphalt became disabled due to an engine problem and pulled off the roadway. The driver’s employer ordered the driver to get back on the road and deliver the asphalt. After returning to the road, the dump truck began to emit white smoke due to a blown diesel turbo, creating a smoke screen on the road. Traveling behind this first dump truck, another dump truck was forced to stop because of the smokescreen. Due to the smokescreen, a husband and wife traveling down the same Ohio roadway could not see the stopped truck in front of them and rear-ended this second dump truck. The husband was killed on impact and the wife was severely injured.
The Law Firm for Truck Safety attorneys, Andrew Young and DJ Young, secured a settlement of $2.095M. If the trucking companies and drivers involved in this crash had prioritized the people on the road over profits, this fatal tragedy could have been avoided.
