Truck crash attorney, Joe Ervin, received a $3.5M settlement in Seminole County, Oklahoma for the wife of an Oklahoma man who lost his life after being dragged under a tractor-trailer.
A Western Flyer Xpress semi-truck driver made an illegal U-turn, crossing into the lane of an oncoming motorcyclist and causing him to collide with the semi-truck trailer and be dragged under it. The driver of the motorcycle pushed his passenger (his wife) off the motorcycle before the impact, in an effort to protect her. He was wearing a helmet. The Western Flyer driver then fled the scene. When EMS responders arrived, they found the driver of the motorcycle lying flat on his back on the highway, with agonal respirations. He was diagnosed at the scene with cardiac arrest secondary to a traumatic injury, a head injury, and respiratory arrest. They also noted chest, abdominal, and neck injuries, as well as his altered mental state.
Upon arrival to the emergency department, CPR was continued. The emergency physician also ordered intubation, an alcohol serum test (normal) and a complete CBC panel (normal). They administered epinephrine, but shortly pronounced him deceased.
The semi-truck driver was deemed at fault for the crash and was later criminally charged.
