Highway 35, Oklahoma
Head-On Crash | Wrongful Death
A produce semi-truck driver fell asleep at the wheel on Interstate Highway 35 and collided with a light pole. Following this first collision, the motor carrier and leasing company worked together to get the driver back in a truck and back on the road in less than four hours. Shortly after, the semi-driver again drifted from his lane, colliding with, and killing a mother of four.
The truck driver later tested positive for methamphetamine. It was also determined that the driver had falsified his logbooks and had been on duty for more than fourteen straight hours in violation of the Federal Motor Carrier Safety Regulations. The Law Firm for Truck Safety’s Joe Ervin settled the case against the motor carrier for the total available insurance policy limits of $7,000,000.00.
