State lawmakers in Minnesota and South Dakota recently passed anti-indemnification legislation that prevents shippers from including contract provisions that make truckers liable for any accident, regardless of who is at fault.
Minnesota Gov. Mark Dayton signed the new law earlier this month, two months after South Dakota Gov. Dennis Daugaard signed a similar anti-indemnification law. According to Transport Topics, 32 states have now passed anti-indemnification laws.
Alabama appears to be on course to become the 33rd state, as the state house recently passed legislation that seeks to protect truckers from contract clauses that make them liable in any truck accident. The Alabama legislation voids contractual provisions in motor carrier transportation contracts that force a carrier to accept liability for another party’s negligence.
